Oakland, CA Short-Term Rentals: Noise Rules (2026)

Oakland adopted Chapter 5.96 of the Municipal Code to regulate short-term residential rentals. Under that chapter, every permitted STR must designate a local responsible party (or hosting platform escalation contact) reachable 24 hours a day, post that contact and the city's noise and conduct rules inside the unit, and provide guests with a written copy of the City's good-neighbor rules at check-in. Guests must comply with Chapter 8.18 quiet hours, generally 10 p.m. to 7 a.m. on weekdays and 11 p.m. to 9 a.m. on weekends, with no plainly audible amplified sound inside neighboring units during those windows. Hosts must respond to noise or nuisance complaints within one hour and take steps to abate the disturbance, including ending events or evicting non-compliant guests. The ordinance bans large parties and events at STRs by limiting overnight occupancy and capping daytime guests. Three substantiated noise or nuisance violations within 12 months can trigger suspension or revocation of the STR permit and disqualification of the property for one year. Oakland 311 and the city's STR enforcement portal accept complaints; major platforms (Airbnb, Vrbo) have agreed to remove non-compliant listings on city request.
