Host presence enters the picture only in the City's proposed STR program. In the City's STROD materials describing the draft, a 'homeshare' is defined as a short-term rental that is the primary residence of either the property owner or designated host, with the 'owner or host physically present.' The August 2025 Council Agenda Report frames one of the central policy decisions for the Council as 'whether a home share option should be developed, and, if so, whether non-hosted home shares should be allowed' โ making clear that host presence is a deliberate, still-undecided design choice rather than an existing rule. The proposal contemplates that homeshares could be allowed more broadly (including in coastal-zone residential areas) precisely because the host's presence is expected to reduce nuisance impacts, in contrast to whole-house, non-hosted STRs. Until the City adopts a home-share or STR ordinance, there is no enforceable host-presence requirement on the books; the operative rules are the hotel-use zoning standards. Any host-presence framework remains subject to Planning Commission, Ordinance Committee, and City Council action in 2026. Santa Barbara County maintains its own separate STR standards for unincorporated areas.
Because no host-presence requirement currently exists in the City code, there is nothing to violate on that specific point today; enforcement instead targets the underlying prohibited or unpermitted STR use and tax non-compliance through the City Attorney's Short-Term Vacation Rental Enforcement Program. If a future home-share ordinance adopts a physical-presence requirement, operating a purportedly hosted home share while the owner or designated host is absent would become independently enforceable. Operators should track the pending ordinance, since the host-presence rules are still being decided.
