Residential fences and walls not over 3.5 feet high are exempt from a building permit. Residential retaining and non-retaining walls not over 4 feet (footing to top) are exempt unless supporting a surcharge or impounding flammable liquids. Taller fences and walls need a permit, and front-yard fences over 3.5 feet trigger design review.
The City of Santa Barbara Community Development Department exempts certain low fences and walls from building permits. Per the City's Work Exempt From Permit handout, residential fences and walls not over three and one-half feet (3.5') high, measured from the lowest adjacent grade within 3.5 feet of the fence, are exempt. Residential retaining walls and non-retaining walls (including masonry and concrete) not over four feet (4') in height measured from the bottom of the footing to the top of the wall are exempt, unless the wall supports a surcharge or impounds flammable liquids, in which case a permit is required. Even where a building permit is not required, the structure must still comply with zoning height and location limits (SBMC 28.87.170 / 30.140). Separately, a building permit to construct, alter or add a wall, fence or gate greater than 3.5 feet in height in the front yard must be referred to the Single Family Design Board for design review (SBMC 22.69.020.C.8), and a retaining wall six feet (6') or greater in height triggers Single Family Design Board review (SBMC 22.69.020.C.7). Properties in the El Pueblo Viejo or Brinkerhoff Avenue Landmark Districts require Historic Landmarks Commission approval.
Building a fence or wall that exceeds the permit-exempt thresholds without the required building permit, or without required design review, is a violation. The City can issue stop-work orders, require after-the-fact permits and review, and order removal of noncompliant work.
