The Jenks Unified Development Ordinance does not require short-term rental operators to carry a specific liability insurance policy. Section 16-5-6(B) of the UDO conditions short-term rental operation only on a Conditional Use Permit, payment of the City lodging tax, compliance with private HOA covenants, and a life safety inspection. The Planning Commission may, however, impose insurance as a condition on an individual Conditional Use Permit.
Jenks UDO Section 16-5-6(B), adopted by Ordinance No. 1581 in April 2022 and amended by Ordinance No. 1624 in October 2023, sets out the four operational standards for a short-term rental: a Conditional Use Permit under Section 16-9-3(D), payment of the City of Jenks lodging tax rate, deference to private HOA covenants, and a life safety inspection. The text does not establish a numeric liability minimum, name a required policy form, or require operators to file a certificate of insurance with the City Clerk or Planning Department. This contrasts with Oklahoma City, which under Chapter 8 Article XIV requires Home Sharing License applicants to maintain liability coverage. Because Section 16-9-3(D)(3) authorizes the Planning Commission to attach individual conditions to a Conditional Use Permit when needed to protect the public welfare, an insurance requirement could appear on a specific Jenks permit, but it is not a citywide ordinance mandate. Most Jenks hosts pair Airbnb's Host Liability or Vrbo's Liability Coverage program (which provide secondary coverage up to $1,000,000 per occurrence on covered platforms) with a dedicated short-term rental endorsement on a homeowner or landlord policy, since standard homeowner policies typically exclude business or transient-lodging use. Operators should also be aware that Tulsa County Health Department rules and the State of Oklahoma Tax Commission lodging tax registration apply.
Because the Jenks UDO itself does not require a specific liability policy, there is no standalone insurance citation under Section 16-5-6(B). However, failing to comply with any insurance condition that the Planning Commission attaches to an individual Conditional Use Permit is a permit violation, and operating without an approved Conditional Use Permit at all is enforceable as a UDO violation through Jenks Code Enforcement and may result in permit termination under Section 16-9-3(D)(7).
