Fort Bend County does NOT require a short-term rental (STR) permit or registration in unincorporated areas β the county has not adopted zoning and has no STR ordinance. However, Fort Bend County did adopt a county Hotel Occupancy Tax effective October 1, 2024 under Texas Tax Code Chapter 352: 7% outside city limits and 2% inside city limits, in addition to the 6% state HOT under Tax Code Β§156.051. Full enforcement began May 1, 2025, with monthly returns due to Avenu (HotelTaxOnline.com) by the 15th. Fort Bend County has not adopted any ordinance requiring registration, permitting, or zoning approval of short-term rentals (rentals under 30 days). STR operators in unincorporated Fort Bend County are nonetheless subject to taxes: (1) State Hotel Occupancy Tax of 6% on rooms costing $15 or more per day under Texas Tax Code Β§156.051, paid to the Texas Comptroller; and (2) Fort Bend County Hotel Occupancy Tax adopted by Commissioners Court effective October 1, 2024 β 7% outside municipal city limits and 2% inside β under Texas Tax Code Chapter 352. The county waived retroactive enforcement and penalties through April 30, 2025; full enforcement and collection began with the May 2025 tax period. Returns are filed monthly to Avenu Insights at HotelTaxOnline.com by the 15th of the following month. Late penalties: 5% on the first day late, an additional 5% on the 31st day, and 10% annual interest after 60 days (Tax Code Β§352.004). Inside city limits, additional municipal HOT and any city STR ordinance also apply β for example, Sugar Land restricts STRs to designated districts and imposes fines up to $2,000 per day for unpermitted operation.
No county STR-permit penalty (no STR ordinance exists). Failure to remit the county HOT triggers a 5% penalty on day 1, an additional 5% penalty on day 31, and 10% annual interest after 60 days under Texas Tax Code Β§352.004. Failure to remit the 6% state HOT can result in audit, penalty, and interest under Tax Code Chapter 156. Operating an STR inside a Fort Bend County city without that city's permit can result in city-level fines (e.g., up to $2,000/day in Sugar Land) and HOA enforcement actions under recorded deed restrictions.
