Hidalgo County does NOT issue short-term rental (STR) permits. Texas Local Government Code Chapter 233 limits county zoning authority over single-family residences in unincorporated areas, so the County cannot require STR registration. Operators must, however, collect the 6% Texas state hotel occupancy tax under Tax Code Β§156.051 on rentals under 30 days, plus any applicable city HOT inside McAllen, Edinburg, Mission, Pharr, or other incorporated areas. HB 2127 (2023) preempts certain local employment-related rules but did not establish statewide STR preemption.
Texas Tax Code Β§156.051 imposes a 6% state hotel occupancy tax on the cost of any room rented for less than 30 consecutive days, including short-term rentals advertised through Airbnb, VRBO, and similar platforms. Operators must register with the Texas Comptroller and remit the tax monthly or quarterly under Β§156.151. Cities in Hidalgo County impose additional local hotel occupancy taxes (typically up to 7% under Tax Code Β§351.003): McAllen, Edinburg, Mission, and Pharr each operate their own HOT collection programs. House Bill 2127 (88th Legislature, 2023, effective Sept. 1, 2023) preempted certain municipal employment, labor, and natural-resources regulations but did not establish a statewide STR preemption β cities and counties retain their existing zoning authority. Because Hidalgo County's authority over single-family homes in unincorporated areas is constrained by Local Government Code Chapter 233, the County does not maintain an STR registration ordinance. Inside city limits, STR rules vary: McAllen requires STRs to comply with general residential zoning and city HOT registration; other Rio Grande Valley cities may impose additional permit or inspection requirements.
Failure to remit state HOT under Tax Code Β§156: Comptroller assesses tax due plus 5% penalty (10% after 30 days) under Β§156.202, plus interest. Willful evasion is a Class C misdemeanor under Β§156.204. City HOT violations are enforced by the city under local ordinance. Operating an unlicensed STR inside a city that requires registration may result in city-level Class C misdemeanor charges with fines up to $500 per day.
