Daly City STR permits expire September 30 each year with the associated business license and must be renewed annually ($142.50). The permit cannot be transferred, does not run with the land, and automatically expires if the property is sold or transferred.
Daly City Municipal Code Section 5.92.070 (Expiration and Renewal, added by Ordinance No. 1440) ties the Short-Term Rental Permit to the host's business license, which expires on September 30 of the year it is issued. The permit may not be transferred, does not run with the land, is valid only at the original short-term rental site, and automatically expires upon sale or transfer of the property; no registration may be assigned, transferred, or loaned to any other person. To renew, a host must: (a) pay registration renewal fees and all required transient occupancy tax remittance, submitting information that lets the Finance Department verify the tax paid; (b) be deemed in conformance with Chapter 5.92 for the past year; (c) document any changes to the information on the current permit; and (d) submit the past year's short-term rental records. Failure to renew before the expiration date results in expiration of the permit. The Planning Division's published renewal fee is $142.50, versus $750.00 for a new permit, so timely renewal is significantly cheaper than reapplying. The ordinance also included a one-time amnesty period (Section 5.92.090): existing short-term rentals with a business license as of the ordinance's enactment had nine months, ending September 30, 2021, to legalize by conforming to the chapter's requirements.
Operating after the permit expires, or attempting to transfer a permit to a new owner or address, violates Chapter 5.92. An expired or transferred permit means the rental is unpermitted, exposing the operator to administrative fines under Chapter 8.16 and the enforcement remedies in Section 5.92.080, including disgorgement of rental revenue.
