Under ARS 9-500.39, Arizona preempts municipalities from requiring a local short-term rental permit or registration separate from the state Transaction Privilege Tax (TPT) license. Marana STR operators must obtain a TPT license through the Arizona Department of Revenue and include the license number in all rental listings and advertising. A vacation rental that lacks a valid TPT license shall not be rented or offered for rent. Marana Ordinance 2024.023, codified at Section 9-14-9, added provisions effective September 14, 2024 requiring that accessory dwelling units (ADUs) constructed on or after that date may only be used as short-term rentals if an owner resides on the property. STRs in Marana may not be used for events requiring town permits, retail businesses, restaurants, or event centers. Property owners must designate a local contact person, but owner liability is not relieved by the failure of a designee. Three verified code violations within a 12-month period can trigger administrative suspension of the right to operate for up to 12 months under ARS 9-500.39.
