Sahuarita may require STR operators to register and provide a local contact person under ARS 9-500.39 and 2022 SB 1168 amendments. State TPT registration with ADOR is mandatory.
Arizona Revised Statutes Section 9-500.39 allows cities to require STR operators to provide contact information and designate a local responsible party. The 2022 SB 1168 amendments explicitly authorize cities to require a local contact person who can respond to complaints within a reasonable timeframe. Sahuarita may implement a registration program under this authority to maintain a database of active short-term rental properties, collect emergency contact details, verify that the property meets building and fire safety codes, and facilitate tax compliance. Separate from local registration, all STR operators in Arizona must obtain a Transaction Privilege Tax license from the Arizona Department of Revenue through the AZTaxes.gov portal. The combined lodging tax rate includes state, Pima County, and Sahuarita components. Major platforms such as Airbnb and Vrbo automatically collect and remit Arizona TPT on behalf of hosts, but operators should verify this in their platform settings. Failure to register for TPT while earning rental income can result in back-tax assessments, penalties, and interest from ADOR. HOAs in Rancho Sahuarita may independently require owners to register rental activity with the association management company.
ADOR penalties for failure to register include back taxes, interest, and penalties. Under SB 1168, Towns may fine operators who fail to provide required contact information. HOA violations handled through CC&R enforcement.
