Arizona law under ARS 36-1681 requires a minimum 5-foot barrier around all residential swimming pools. Sahuarita enforces pool fencing requirements through building permits and inspections administered by the Building Safety Division.
Arizona Revised Statutes Section 36-1681 mandates that all residential swimming pools, including above-ground pools capable of holding water deeper than 18 inches, must be completely enclosed by a barrier at least 5 feet in height. The barrier must have no openings or gaps that would allow a sphere of 4 inches in diameter to pass through. Gates in pool barriers must be self-closing and self-latching, with the latch mechanism at least 54 inches from the ground on the pool side to prevent young children from reaching it. Doors from a house that open directly to the pool area must have alarms or self-closing devices. The 5-foot barrier requirement applies to the full perimeter of the pool, and existing walls or fences that meet the height requirement can serve as part of the barrier. Sahuarita enforces these requirements through the building permit and inspection process. Pool barrier compliance is verified during initial construction inspection and may be re-inspected during property transfers. Rancho Sahuarita HOA may have additional requirements regarding barrier style and materials that must be coordinated with the state safety requirements. Non-compliance creates significant liability exposure in the event of a drowning or near-drowning incident.
Building code violation enforced by Sahuarita Building Safety. Stop-work orders for pools under construction without compliant barriers. Severe civil liability for drowning incidents at non-compliant pools.
