Sahuarita prohibits the storage of abandoned, inoperable, or junk vehicles on residential properties and public streets. Vehicles must be registered, operable, and stored on paved surfaces.
Under the Sahuarita Town Code, vehicles that are inoperable, unregistered, or in a state of disrepair that prevents legal operation constitute a public nuisance when stored on residential property or parked on public streets. Vehicles on public streets that remain unmoved for more than 72 hours may be tagged and towed as abandoned. On private property, junk vehicles with missing parts, flat tires, broken windows, or expired registration must be stored inside a fully enclosed garage or removed from the premises. Storing inoperable vehicles outdoors, even in backyards, violates nuisance provisions if they are visible from neighboring properties or public areas. Arizona law under ARS 28-4802 provides additional authority for removing abandoned vehicles from private property. Code enforcement officers issue notices giving property owners a specified period, typically 10 to 30 days, to bring vehicles into compliance or remove them. After the notice period expires, the town may arrange for towing at the owner expense. Classic or collector vehicles undergoing restoration may be exempt if stored in an enclosed structure. HOA communities enforce their own abandoned vehicle provisions, which are typically stricter than Town Code.
Nuisance citation with abatement deadline. Towing at owner expense after notice period. HOA fines and potential lien for non-compliance.
