Sugar Land does not issue a citywide STR registration permit. Instead, short-term rentals are permitted only in R-2, R-3, and R-4 zoning districts and only after the property owner secures a Conditional Use Permit (CUP) under the Sugar Land Development Code Land Use Matrix (Sec. 2-71). STRs are prohibited in R-1E, R-1, R-1R, and R-1Z districts.
The City of Sugar Land regulates short-term rentals through its Land Development Code (Municode, Land Development Code Sec. 2-71 Land Use Matrix) rather than through a standalone registration ordinance. An STR is defined as a dwelling, or any portion such as a single room, leased for fewer than 30 consecutive days. Rentals of 30 days or more are not classified as STRs and are not subject to the CUP requirement. STRs are listed as a Conditional Use (C) only in the R-2, R-3, and R-4 residential districts; they are not allowed in the R-1E, R-1, R-1R, or R-1Z single-family districts. To obtain a Conditional Use Permit the owner must apply through the Planning Department, which routes the request through the Planning and Zoning Commission and ultimately City Council, with notice to surrounding property owners. Beyond the CUP, every Sugar Land STR operator must register with the Texas Comptroller for the 6% state Hotel Occupancy Tax (Tex. Tax Code Ch. 156) and must remit any applicable city HOT under Tex. Tax Code Ch. 351 (which caps non-resort municipal HOT at 7%). Texas has no statewide STR preemption statute and no statewide STR insurance mandate. Operating an STR without a Conditional Use Permit, or in an ineligible R-1, R-1E, R-1R, or R-1Z district, violates Sugar Land zoning regulations. The city's published guidance states violations of city zoning rules can result in fines of up to $2,000 per day, with each day of unpermitted operation treated as a separate offense.
