Davis Municipal Code Section 15.05.020 imposes a transient occupancy tax (TOT) of 12% on the rent for any stay of 30 days or less; occupancy continuous for more than 30 days is exempt. Voters raised the rate from 10% to 12% via Measure B in June 2016, and the city has an agreement with Airbnb to collect and remit the 12% TOT including cleaning fees. Operators must register under Section 15.05.050 and file returns. Hosts also pay for a business license under Chapter 19, and non-owner-occupied rentals pay registration fees. California imposes no statewide TOT, so this city tax is the only lodging tax.
Failing to register, collect, or remit the 12% TOT, or operating without a business license, exposes the operator to back taxes, interest, and penalties under Chapter 15.05 and Chapter 19.
