Texas Election Code Sec. 259.003 forbids a city ordinance from banning, charging for, permitting, or restricting the size of a political sign on private property with the owner's consent, except signs over 36 sq ft, taller than 8 feet, illuminated, or with moving elements. The City of Galveston LDR Sec. 5.413 mirrors this: no permit is needed for conforming signs, they may go on private property or the adjacent right-of-way up to 90 days before an election, and right-of-way signs must come down within 10 days after. The county sets no political-sign rule in unincorporated areas.
Non-exempt signs (over 36 sq ft, over 8 feet, lit, or moving) require a sign permit; signs left in the right-of-way past 10 days after an election may be removed by the city.
