Under CMC 8.32.090, non-motorized vending equipment including push carts, wagons, pedal carts, and bikes shall not exceed 6 feet in length and 4 feet in width. No sidewalk vendor shall use vending equipment in a manner that endangers the safety of persons or property or causes a public or private nuisance, including but not limited to the use of an open flame. Propane-fueled cooking equipment is permitted only if it meets California Retail Food Code standards and is properly secured. Vendors must keep their area clean and remove all trash, grease, and waste at the end of each day. Equipment must not block ADA-required pedestrian access (a minimum 4-foot-wide passable sidewalk must remain clear, per ADA Section 403). Generators producing noise above the ambient level may violate CMC 8.48 noise rules.
Non-compliant equipment is subject to administrative civil citations under CMC 8.32: $100 for a first violation, $200 for a second within a year, and $500 for subsequent violations. Equipment using prohibited open flames or unsafe propane setups may be subject to immediate impoundment by the Fire Marshal under California Fire Code 109. Repeated violations may result in permit revocation.
