CMC 8.32 prohibits sidewalk vending on city beaches, piers, public squares, street ends, alleys, parking lots, and parking spaces. Vendors must maintain minimum distances from curbs, other vendors, outdoor dining, and special events.
Under CMC 8.32, sidewalk vendors may not operate in or on any alley, beach, pier, square, street, street end, parking lot, or parking space within Carlsbad. Specific distance restrictions include: at least 18 inches from the curb, at least 50 feet from another sidewalk vendor, at least 10 feet from any outdoor dining or patio area, and at least 500 feet from any permitted special event, street fair, or farmers' market. Vendors may not operate within 500 feet of a school during school hours when selling food. Beach prohibitions apply to all city-controlled beaches including Tamarack State Beach access points. The chapter reserves authority to designate additional restricted zones based on documented health, safety, and welfare concerns consistent with SB 946.
Operating in a prohibited zone is enforced through administrative civil citations under CMC 8.32: $100 for the first violation, $200 for the second within one year, and $500 for each subsequent violation. The vending equipment permit may be revoked after multiple violations. Per SB 946, criminal citations are not authorized.
