Street vendor permits in Carlsbad, CA β sometimes called sidewalk vendor licenses, mobile vendor permits, or peddler permits β are the licenses required to sell goods or food on public property.
Carlsbad regulates sidewalk vendors under CMC Chapter 8.32 (Vending and Soliciting), enacted to comply with California Safe Sidewalk Vending Act (SB 946). All sidewalk and food-truck vendors using motorized vehicles or non-motorized conveyances must obtain a vending equipment permit, renewed annually, and a city business license.
Under CMC 8.32, all sidewalk vendors and food-truck operators wishing to use a motorized vehicle or non-motorized conveyance for vending must obtain a vending equipment permit for each conveyance before use on any public street, sidewalk, or right-of-way. The permit is valid for one calendar year from the date of issuance and must be renewed annually. Non-motorized vending equipment, including push carts, wagons, pedal carts, or bikes, may not exceed 6 feet in length and 4 feet in width. Vendors must carry liability insurance and execute a release and indemnification agreement under CMC 8.32.050. Food vendors must also hold a San Diego County Department of Environmental Health permit. The ordinance complies with SB 946 (Government Code 51036-51039), which limits cities from criminalizing sidewalk vending and caps fines at administrative civil amounts.
Violations carry administrative civil fines only, consistent with SB 946: $100 for a first violation, $200 for a second within one year, and $500 for each subsequent violation under CMC 8.32. Vending without the required permit cannot result in a criminal citation. Repeated violations may trigger permit revocation.
