A pool deeper than 18 inches must also comply with Municipal Code Chapter 9.52 and the city's Swimming Pool and Spa Code (Chapter 20.15), and a new pool at a single-family home must include the state-mandated drowning-prevention features under HSC 115922. Whether a building permit is required for a particular above-ground pool depends on its size and depth under the adopted construction code; the city's Building Division determines that and reviews the installation. Temporary, very shallow inflatable or wading pools at or under 18 inches deep generally fall outside the Section 23.12.150 safety thresholds, but owners remain responsible for child safety.
Placing an above-ground pool in a required front yard, or closer than the three-foot/five-foot water-line setbacks, violates Section 23.12.150. An above-ground pool deeper than 18 inches that lacks the required Chapter 9.52 barriers or, for a new installation, the state drowning-prevention features, is in violation of the zoning and building codes and can be cited by Code Enforcement.
