Wake County requires a building permit AND electrical permit for any pool, hot tub, or spa that holds more than 24 inches of water β including above-ground pools. The NC Residential Code Appendix V requires a barrier at least 48 inches high with self-closing self-latching gate.
Wake County Inspections treats above-ground pools the same as in-ground: any container holding water over 24 inches deep triggers building + electrical permits. Above-ground pools with walls themselves over 48 inches serve as their own barrier IF ladders are removable or have a lockable cover, per Appendix V (NCRC Section AV105.2.2). Otherwise a separate 48-inch fence is required. Pump and heater circuits must be GFCI-protected (NEC Art. 680). Septic-system setbacks apply to ALL pools β Wake County requires consultation with Environmental Health before installation. Drainage from the pool may not be discharged to a septic drainfield.
Installation without permit: civil penalty plus possible removal order. Failure to add required barrier: fine plus mandatory closure until corrected. Drainfield damage: separate Environmental Health citation.
