Evanston's building code, based on the International Residential Code as adopted by Illinois, requires a building permit for above-ground pools capable of holding more than 24 inches of water. The permit application is submitted through the Community Development Department at (847) 448-4311. All pools, including above-ground models, must be surrounded by a barrier at least 48 inches high that prevents uncontrolled access by children. If the pool walls serve as the barrier, they must be at least 48 inches above grade and the access ladder must be removable or lockable. Pool equipment must comply with National Electrical Code requirements and an electrical permit is needed for wiring pumps, filters, and lighting. Pools must maintain side and rear yard setbacks as required by the applicable residential zoning district. Water discharge from draining or backwashing must not flow onto neighboring properties or into the storm sewer without approval. Inflatable pools under 24 inches deep are generally exempt from permitting but barrier requirements still apply if they can hold water deep enough for a drowning hazard.
Installing a pool without a permit is a building code violation subject to fines of $75-$500 per day. Failure to provide required barriers around a pool can result in immediate code enforcement action and fines. The city may require removal of non-compliant pools. Electrical work without a permit creates safety liability and may result in additional fines.
