Above-ground swimming pools in Arlington Heights require a building permit and must meet the same fencing and safety requirements as in-ground pools. Pools must maintain setbacks from property lines and may not be placed in front yards. Inflatable pools under 24 inches deep are generally exempt from permit requirements but must still comply with water drainage rules.
Arlington Heights requires a building permit for above-ground swimming pools. The same setback, fencing, and safety requirements that apply to in-ground pools also apply to above-ground installations. Above-ground pools must be set back at least 10 feet from rear and side property lines and are prohibited in front yards. The pool wall itself may count toward the barrier height requirement if it meets the minimum 5-foot height and has no climbable features on the exterior. However, a separate fence is still required around pools with walls lower than 5 feet. Decks or platforms attached to above-ground pools that provide access must have self-closing, self-latching gates. Electrical connections for pumps and filters require an electrical permit and GFCI protection. Small inflatable or kiddie pools under 24 inches in water depth are generally exempt from permit and fencing requirements but must still be emptied when not in use to avoid mosquito breeding and must not discharge water onto neighboring properties. Above-ground pool structures must be maintained in good condition and removed if they become deteriorated or pose a safety hazard.
Installing an above-ground pool without a permit is subject to fines starting at $250 per day. Pools without adequate fencing must be drained until compliant barriers are installed. Deteriorated above-ground pools that present safety hazards may be ordered removed. Contact Community Development at (847) 368-5100.
