Arlington Heights requires all residential swimming pools to be enclosed by a fence or barrier at least 5 feet in height. Gates must be self-closing and self-latching with latches at least 54 inches above grade. The barrier must completely prevent uncontrolled access to the pool area, particularly by young children.
The Village of Arlington Heights mandates that every outdoor swimming pool be completely enclosed by a fence, wall, or other approved barrier not less than 5 feet in height measured from the finished grade on the outside of the barrier. The barrier must not have openings, holes, or gaps that would allow a sphere 4 inches in diameter to pass through. Chain-link fencing must have a mesh size no larger than 1.25 inches. All gates in the pool barrier must be self-closing and equipped with self-latching hardware. Gate latches must be located at least 54 inches above grade on the pool side, or the gate must be equipped with a key lock or combination lock. Gates must open outward away from the pool area. The dwelling wall may serve as part of the barrier if all doors providing direct access to the pool area are equipped with self-closing devices and alarms. Pool covers are not accepted as a substitute for fencing requirements. The barrier must be in place before the pool is filled. Inspections of fencing are conducted as part of the pool permit process.
Failure to maintain required pool fencing is a code violation subject to fines. The Village may issue an order requiring immediate correction. Repeated violations may result in fines of $100-$750 per offense. If a pool barrier is found to be inadequate, the pool must be drained or covered until compliant fencing is installed.
