Above-ground pools with sides at least 48 inches tall may use the pool wall as part of the barrier, but access ladders or steps must be removable or have a lockable gate. The Illinois Swimming Pool and Bathing Beach Act (210 ILCS 125) and the village's building code require pool barriers for all pools over 24 inches deep. The barrier must be in place and inspected before the pool can be filled and used. Fencing must comply with the village's general fence regulations regarding materials and placement.
Failure to install or maintain required pool barriers is a serious safety violation. The village may order immediate cessation of pool use until barriers are installed. Fines range from $100 to $750 per day. If an incident occurs due to lack of required fencing, the property owner faces potential civil liability.
