Sutter County, CA Swimming Pools & Spas: Above-Ground Pools (2026)

Unincorporated Sutter County does not exempt above-ground pools from its pool rules. The County uses the California definition of a swimming pool, any structure intended for swimming or recreational bathing that contains water over 18 inches deep (Health & Safety Code section 115921), which captures most above-ground and inflatable pools. An above-ground pool therefore requires a building permit from the Development Services Department and must satisfy the same drowning-prevention and barrier requirements as an in-ground pool, including the 60-inch minimum barrier height and the self-closing, self-latching gate with a latch at least 60 inches above the ground (Ordinance No. 1350-20). Where the wall of an above-ground pool serves as part of the barrier, any attached ladder or steps must be capable of being secured, locked, or removed to prevent access, and the remaining barrier above the pool wall must still meet the maximum-opening limits. Because the County ties the barrier inspection to the permit, an above-ground pool cannot lawfully be filled and used until the barrier configuration is approved.
