Anything above the threshold triggers a full building permit. Regardless of permit status, the pool counts as a 'swimming pool' under HSC §115921(a) (any structure for swimming or wading containing water more than 18 inches deep) and triggers the §115922-115923 barrier rules. For above-ground pools with walls at least 48 inches high, the pool wall can serve as the barrier if the ladder is removable or lockable when not in use and any attached deck/steps are gated with self-latching hardware. The 3-foot bond-beam setback from the Yuba City Swimming Pool Guidelines applies to permitted above-ground pools as well.
Installing an above-ground pool over 24 inches or 5,000 gallons without a permit is a stop-work item and incurs double permit fees (CBC §109.4). Leaving an unsecured ladder on a barrier-pool when not in use is an infraction under YCMC Title 1 / Cal. Gov. Code §36900(b) ($100 / $200 / $500). Code Enforcement may require removal of the pool if the property cannot pass barrier inspection before filling.
