Above-ground pools and portable spas in Mission Viejo require a building permit and must comply with the city's pool barrier rules at MVMC Section 8.02.180 plus the California Pool Safety Act (Health & Safety Code 115920-115929). Any pool or spa capable of containing water 18 inches or more in depth must be enclosed by a barrier and meet drowning-prevention safety requirements. Portable spas must carry a UL or IAPMO listing.
Above-ground pools, portable spas, and inflatable pools deeper than 18 inches are regulated as 'swimming pools' under California Health and Safety Code Section 115921. The City of Mission Viejo Building Services Division (949-470-3054) issues pool permits and applies MVMC Section 8.02.180 together with current California Building and Residential Code provisions. Per current state law (HSC 115923, amended by AB 3196 effective 2018), pools constructed or remodeled after Jan. 1, 2018 must have at least two of seven approved drowning-prevention safety features, one of which is typically an enclosure. Where a barrier is used, current state law requires the top of the barrier to be at least 60 inches above grade (the city's older 2008 Building Services handout still cites 5 feet, but the higher state standard governs). Vertical openings may not exceed 4 inches and the gap at the bottom may not exceed 2 inches over earth or 4 inches over a hard deck. Access gates must be self-closing and self-latching, open outward away from the pool, with the latch at least 54 inches above grade. Doors from the house to the pool area must have an alarm or be self-closing/self-latching. The pool wall itself can serve as part of the barrier when the side is at least 60 inches high and ladders are removable or lockable. Mission Viejo also requires neighbor consent and HOA/Architectural Control Committee approval before a permit will issue, and pools over 750 gallons need a 3-inch P-trap and backwash line. Anti-entrapment drain covers (ASME/ANSI A112.19.8) and dual-drain plumbing under HSC 115928 apply to all new pools and spas including above-ground.
Installing or operating an above-ground pool deeper than 18 inches without a permit or without the required barrier is a code violation handled by Mission Viejo Code Enforcement (949-470-3000).
