Carmel treats above-ground and in-ground pools alike: a swimming pool, hot tub, or its deck or equipment must sit at least 10 feet from side and rear lot lines and 3 feet from any easement, plus meet the four-foot barrier rule.
Hamilton County's cities do not carve out a lighter rule for above-ground pools. Under Carmel UDO 5.02(C)(7), any private swimming pool, hot tub, or its deck or equipment must be set back a minimum of ten feet from the side and rear lot lines, or three feet from any easement, whichever is greater, and no excavation fill may be placed within three feet of an easement. Above-ground pools over 24 inches deep still require a city building permit and the same four-foot self-latching barrier as in-ground pools. Fishers, Westfield and Noblesville apply comparable setback and barrier standards. Placement in front yards is generally prohibited.
An above-ground pool set too close to a lot line or without a barrier is a zoning/building violation; the city can order relocation or removal.
