Hot tubs, spas, and portable spas are treated as 'permanent swimming pools' or 'non-permanent pools' under UDO Section 159.121 depending on installation type. A permanent in-ground or built-in spa is subject to the same four-foot fence / safety cover rule as a swimming pool ('Permanent swimming pools shall be protected by a surrounding fence at least four feet in height, which is maintained to prevent access by small children or animals, and/or by a safety pool cover that meets all specifications set forth in the adopted Indiana Swimming Pool Code'). A non-permanent (portable) hot tub or spa 'shall meet all accessory building structure regulations but [is] not subject to the safety and screening regulations of permanent pools.' Section R326 of the Indiana Residential Code 2020 provides the technical floor: barriers must comply with the 48-inch / 4-inch sphere / self-closing-self-latching-gate rules unless the spa or hot tub is equipped with 'a safety cover that complies with ASTM F1346,' in which case the barrier requirements do not apply (R326 exception). The ASTM F1346 cover must be listed and labeled, capable of supporting a 400-pound concentrated load, and securable to prevent removal by a child. A building permit is required from the Noblesville Department of Planning and Development (317-776-6325) for hot tub or spa installations involving electrical or plumbing work. Electrical bonding inspections are required under the National Electrical Code adopted via IC 22-12; the City's Lower and Upper Bonding inspections must be passed before bond wires are covered. Plumbing must be by an Indiana-licensed plumber under IC 25-28.5 (Indiana Plumbing Commission). HOA covenants in many Hamilton County subdivisions impose location restrictions on outdoor hot tubs that exceed the UDO ceiling.
