Noblesville pool fencing is governed by UDO Section 159.121 and the Indiana Residential Code 2020 Section R326 (Swimming Pools, Spas and Hot Tubs) adopted statewide under IC 22-12 / 675 IAC 14-4.4. UDO Section 159.121 requires permanent pools to be protected by a fence at least four feet in height and/or a compliant safety pool cover. Section R326 sets the technical floor: 48 inches above grade minimum, openings under 4 inches, self-closing/self-latching gates opening outward, and additional alarm or cover protections where a dwelling wall serves as the barrier.
UDO Section 159.121 provides: 'Permanent swimming pools shall be protected by a surrounding fence at least four feet in height, which is maintained to prevent access by small children or animals, and/or by a safety pool cover that meets all specifications set forth in the adopted Indiana Swimming Pool Code. If a surrounding fence is used, the fence may be located around either the pool itself or the property on which the pool is located.' The Indiana Residential Code 2020 (675 IAC 14-4.4 adopting the 2018 IRC with Indiana amendments) Section R326 sets the binding technical floor enforced statewide under IC 22-12. Key R326 (Appendix G derived) provisions: (1) the top of the barrier shall be at least 48 inches above grade measured on the side facing away from the pool; (2) the maximum vertical clearance between grade and the bottom of the barrier is 2 inches on the side facing away from the pool; (3) openings shall not allow the passage of a 4-inch-diameter sphere; (4) for fences where horizontal members are less than 45 inches apart, horizontal members shall be on the swimming pool side and spacing between vertical members shall not exceed 1-3/4 inches; (5) chain-link mesh maximum 1-1/4 inches square unless slatted to 1-3/4 inches; (6) gates shall comply with barrier requirements, open outward away from the pool, be self-closing and self-latching, and accommodate a locking device; (7) if the release mechanism is less than 54 inches from the bottom of the gate, it shall be located on the pool side at least 3 inches below the top of the gate with no opening larger than 1/2 inch within 18 inches of the release. Where a wall of a dwelling serves as part of the barrier (R326), doors with direct pool access must be equipped with an alarm complying with UL 2017, a self-closing/self-latching device, a powered safety cover complying with ASTM F1346, or an approved alternative. Non-permanent (portable) pools per UDO Section 159.121 'shall meet all accessory building structure regulations but are not subject to the safety and screening regulations of permanent pools.'
Failure to maintain a compliant barrier is the most common pool-code violation. Self-closing gates that have failed, latches below 54 inches that are not pool-side, openings larger than 4 inches, and barriers under 48 inches all trigger code-enforcement action by the Department of Planning and Development. Climbable objects within reach of the barrier (chairs, ladders, AC units, planters) must be removed. The City may require the pool to be drained or covered until violations are corrected.
