Pinellas County treats above-ground pools the same as in-ground pools when they hold more than 24 inches of water, requiring a building permit and a compliant barrier under the Florida pool safety act.
Neither the Florida Building Code nor Florida Statute 515 distinguishes between above-ground and in-ground residential pools once water depth exceeds 24 inches. In Pinellas County, an above-ground pool deeper than 24 inches requires a building permit, structural review for the pool wall and surrounding deck, electrical bonding, and a barrier meeting Section 515.29. A removable ladder is not by itself a compliant barrier; if the ladder is the only access, it must be removable, lockable, and combined with a perimeter barrier or with a Section 515.27 alternative such as an alarmed door or approved pool cover. Soft-sided and inflatable pools that meet the depth threshold are subject to the same rules.
Installing a regulated above-ground pool without permits or a compliant barrier can result in stop-work orders, daily code enforcement fines, and orders to remove or properly enclose the pool.
