Colusa County has no zoning provision singling out above-ground pools. They are treated as accessory structures for setback purposes and, where a building permit applies, must meet the same California Swimming Pool Safety Act barrier and feature requirements as in-ground pools.
The Colusa County Zoning Code does not list swimming pools, above-ground or otherwise, as a separately regulated use, and it contains no fence-height chapter. For placement, an above-ground pool that qualifies as a structure follows the County's accessory-structure setbacks in the residential development standards table (Table 44-2.30-2). In the Rural Residential and single-family residential zones, accessory structures generally observe a 5-foot front and rear setback, a 3-foot interior side setback, and a 10-foot street-side setback, and must be at least 5 feet from any building; owners on agricultural parcels should confirm the standards for their specific zone. For safety, the California Swimming Pool Safety Act (Health and Safety Code 115922) applies to above-ground pools and spas the same way it applies to in-ground pools: when a building permit is issued for a new or remodeled pool, at least two of the seven drowning-prevention features must be provided. The wall of a tall above-ground pool can serve as part of a barrier only if the overall installation, including any ladder or access point, satisfies the enclosure and feature requirements. Because there is no local ordinance, owners should confirm with the County Building Department whether their specific above-ground pool requires a permit.
Placing a pool inside a required setback or skipping a needed building permit can lead to correction notices, relocation, or added permit fees. Inadequate barriers will fail inspection under the state Safety Act.
