Section 4-03-03-02-15 of the Development Standards and Regulations treats a tall above-ground pool wall as the barrier itself: pools standing at least 48 inches above the surrounding grade are exempt from the separate fence requirement that applies to in-ground pools. If the wall is lower, or a deck/ladder gives easy access, a compliant 48-inch enclosure with self-latching gates is still required. All installations, above-ground included, need both a building permit and an electrical permit from the Community & Economic Development Department. Cities set their own above-ground pool rules within their limits.
Installing an above-ground pool without required permits, or with easy access that defeats the 48-inch barrier standard, is subject to county code enforcement.
