Above-ground pools, spas and hot tubs need the same building permit and barrier as in-ground pools. The pool wall itself may serve as the barrier if it is at least 48 inches high; any ladder or steps must be lockable, removable, or separately fenced to block access.
Washoe County's residential handout treats in-ground, above-ground and on-ground pools identically for permits and barriers. Where an above-ground structure acts as the barrier, or a barrier is mounted on top of it, the maximum gap between the pool structure and the barrier bottom is 4 inches. If access is by ladder or steps, they must be capable of being secured, locked or removed, or be surrounded by a compliant barrier; when secured, any opening must not pass a 4-inch sphere. Inflatable and portable pools deep enough to hold water still fall under these barrier rules.
Leaving a climbable ladder in place without securing, locking or removing it, or without a surrounding barrier, is a barrier violation corrected through failed inspection and county enforcement.
