Across Atlantic County the pool fence rule is state code, not a town invention. The New Jersey Swimming Pool and Spa Code, Section 305.2.1, demands a barrier at least 48 inches high around every outdoor pool.
New Jersey adopts the International Swimming Pool and Spa Code as a UCC subcode, so the barrier standard reads identically in Atlantic City, Egg Harbor Township, and Hammonton. Section 305.2.1 requires the top of the barrier to stand not less than 48 inches above grade on the side facing away from the pool, around the entire perimeter. Gaps beneath a non-solid surface cannot exceed two inches, and no opening may pass a 4-inch sphere. Under N.J.A.C. 5:23-2.14 a pool barrier needs a permit even though an ordinary six-foot fence does not.
A pool filled without a compliant 48-inch barrier fails inspection and draws a stop-use order and penalties until the enclosure is built. A gap wider than four inches is a cited defect.
