New Jersey adopts the International Swimming Pool and Spa Code as a UCC subcode, so the barrier standard reads identically in Bridgewater, Franklin Township, and Somerville. Section 305.2.1 requires the top of the barrier to stand not less than 48 inches above grade on the side facing away from the pool. Gaps beneath a non-solid surface cannot exceed two inches, and no opening may pass a 4-inch sphere. Under N.J.A.C. 5:23-2.14 a pool barrier needs a permit even though an ordinary six-foot fence does not.
A pool filled without a compliant 48-inch barrier fails inspection and draws a stop-use order and penalties until the enclosure is built. A gap wider than four inches is a cited defect.
