Under ORS 455.020 and 455.030, Oregon's Building Codes Division adopts a uniform statewide code, including the Oregon Residential Specialty Code (ORSC) Appendix V. ORSC requires barriers at least 48 inches high around residential swimming pools, spas, and hot tubs holding water more than 24 inches deep. Gates must be self-closing and self-latching with latches at least 54 inches above grade. Above-ground pool walls 48 inches tall may serve as the barrier if ladders are removable or lockable. ORS 455.040 prohibits cities and counties from amending the code to be less restrictive, ensuring uniform child-drowning protections statewide.
Building code violations are enforced through stop-work orders, permit revocation, and civil penalties up to $5,000 per violation under ORS 455.895. Insurance and liability exposure also apply.
