Florida's Residential Swimming Pool Safety Act requires at least ONE of the following for residential pools built after Oct 1, 2000: (1) a barrier at least 48 inches high with a self-closing, self-latching gate; (2) an approved safety pool cover; (3) exit alarms on all doors and windows providing direct access from the home to the pool; or (4) self-closing, self-latching devices on all such doors with release mechanisms at least 54 inches above the floor. Duval County Building Inspection verifies compliance at final inspection. Pool enclosures (screen cages) often satisfy barrier requirements when built to Florida Building Code.
Failure to maintain barrier is a second-degree misdemeanor under FL Β§515.29 (up to 60 days jail, $500 fine) after first conviction if not remediated within 45 days.
