Harford County enforces the 2021 International Swimming Pool and Spa Code as Maryland's building standard. Section 305.2.1 requires every outdoor residential pool or spa to be enclosed by a barrier whose top is at least 48 inches above grade, measured on the side facing away from the pool. Openings cannot pass a 4-inch sphere, and there can be no handholds or footholds that let a child climb. The barrier must be complete before the pool is filled. Public and semipublic pools carry a stricter 60-inch enclosure under the Maryland Department of Health rule, COMAR 10.17.01.21.
Filling a pool without a compliant 48-inch barrier fails inspection and draws a stop-use order and fines until the enclosure is built. A gap wider than four inches is a cited defect.
