Residential pool barriers in Flowood are governed by the Mississippi Residential Code (IRC-based, adopted under Flowood's Building Code Adoption ordinance amended May 1, 2023), which requires a 48-inch barrier with a 4-inch maximum sphere passage. Pools serving multi-unit complexes or property-owner associations must additionally comply with the William Lee Montjoy Pool Safety Act, Miss. Code Ann. Sections 45-43-1 through 45-43-31, including a 60-inch latch height (Sec. 45-43-9) and a prohibition on diagonal members below 49 inches (Sec. 45-43-7) for new enclosures built after July 1, 2012.
Flowood adopts the International Residential Code through its Building Code Adoption ordinance (cityofflowood.com, amended May 1, 2023). The IRC's pool barrier appendix (formerly IRC AG105, now Appendix G) requires a barrier at least 48 inches above grade on the outside, with a maximum 2-inch ground clearance, no openings that allow passage of a 4-inch sphere, and self-closing, self-latching gates that swing outward away from the pool. For pools owned, controlled, or maintained by a property owners association or located at a multi-unit rental complex, the Mississippi William Lee Montjoy Pool Safety Act (Miss. Code Ann. Sections 45-43-1 through 45-43-31) applies. Section 45-43-7 prohibits diagonal fencing members lower than 49 inches above the ground for new pool yard enclosures constructed after July 1, 2012, and prohibits chain-link entirely on those new enclosures. Section 45-43-9 requires gate hardware enabling locking and a latch installed at least 60 inches above the ground - lower placement is allowed only on the pool-yard side of the gate, at least 3 inches below the top, and with no opening greater than 1/2 inch within 18 inches of the latch. Flowood building inspectors verify these standards at the final inspection. A building permit is required for any in-ground or above-ground pool.
Installing a pool without a building permit or with a non-conforming barrier violates Flowood's Building Code Adoption ordinance and, where applicable, the Mississippi Pool Safety Act. The Building Department can issue stop-work orders and withhold a certificate of occupancy until the barrier is brought into compliance. Civil penalties under Miss. Code Ann. Title 45, Chapter 43 may also apply for HOA-owned pools, and a non-compliant pool can be cited as an attractive nuisance.
