Residential swimming pool barriers in Brandon are governed by the Mississippi Pool Safety Act (William Lee Montjoy Pool Safety Act), Miss. Code Ann. Sections 45-43-1 through 45-43-31, plus the Mississippi Residential Code (based on the IRC). Barriers must be at least 4 feet high on the outside, with diagonal members lower than 49 inches prohibited on new pool yards built after July 1, 2012. Mississippi enacted the William Lee Montjoy Pool Safety Act, codified at Miss. Code Ann. Sections 45-43-1 through 45-43-31, which applies statewide to certain residential pool yard enclosures. Section 45-43-7 prohibits the use of diagonal fencing members lower than 49 inches above the ground for any new pool yard enclosure constructed after July 1, 2012. Section 45-43-9 requires that any gate in the pool-yard enclosure have hardware enabling it to be locked by padlock or built-in lock operated by key, card, or combination, and that the gate latch be installed at least 60 inches above the ground - unless the latch is mounted on the pool-yard side of the gate, is at least 3 inches below the top of the gate, and the enclosure has no opening greater than 1/2 inch within 18 inches of the latch. Brandon enforces these state requirements together with the Mississippi Residential Code (adopted statewide based on the IRC) through the Office of Community Development under Brandon Code Chapter 18 (Buildings). A building permit is required for any in-ground or above-ground pool installation per the City of Brandon Permits & Licenses page. Inspectors verify barrier height, opening size, gate hardware, and latch placement before approving final inspection.
Installing a pool without a building permit or with a non-conforming barrier violates Brandon Code Chapter 18 and the Mississippi Pool Safety Act. The Office of Community Development can issue stop-work orders, withhold final inspection approval, and require corrective work. Civil penalties under Miss. Code Ann. Title 45, Chapter 43 may also apply, and a non-compliant pool may be cited as an attractive nuisance under common law.
