Section 305.2.1 of the New Jersey Swimming Pool and Spa Code sets a minimum 48-inch barrier height measured on the side facing away from the pool. Ground clearance at the bottom of the barrier cannot exceed 2 inches over grass/gravel or 4 inches over a solid surface, and openings must not pass a 4-inch sphere. Gates must be self-closing and self-latching. Public recreational bathing places regulated by the Burlington County Health Department follow N.J.A.C. 8:26-3.12, which points back to the same UCC fencing standard plus a self-closing, self-latching gate.
A pool without a compliant barrier fails inspection; the municipal construction official can withhold approval and require correction before the pool is used.
