The William Lee Montjoy Pool Safety Act (Miss. Code Β§45-43-1 et seq.) sets statewide minimum pool barrier rules that Long Beach enforces in addition to local code. Outdoor residential pools deeper than 24 inches must be enclosed by a fence or wall at least four feet high with no gaps that pass a 4-inch sphere. Gates must be self-closing, self-latching, open outward from the pool, and have latches at least 60 inches above the ground or with locking hardware. State law expressly does not exempt pool yards from additional local ordinance requirements.
Mississippi's Montjoy Pool Safety Act (Β§Β§45-43-1 through 45-43-31) requires every outdoor pool deeper than 24 inches to be surrounded by a barrier of at least 48 inches with self-closing, self-latching gates that swing outward; latches must be 60+ inches high or fitted with a padlock/built-in lock per Β§45-43-9. Β§45-43-11 makes the requirements applicable to existing pool yard enclosures and Β§45-43-7 covers fence specifications. Mississippi Residential Code Chapter 42 (IRC AG105) is the building-code companion. Long Beach's Building Permit Office reviews pool plans and inspects barrier compliance; the state act explicitly preserves any stricter local ordinance.
Operating a pool without a compliant barrier is a misdemeanor under state law and triggers building-code stop-work or correction orders. Owners can be held civilly liable for child drownings where barriers were noncompliant.
