Required barrier features: minimum 48 inches high measured outside the enclosure; maximum 2-inch gap below the barrier; vertical picket openings no more than 4 inches (reduced to 1.75 inches if chain-link or diagonal); self-closing, self-latching gates opening outward from the pool with the latch release at least 54 inches above ground (or on the pool side of the gate if 40+ inches above grade); no climbable horizontal rails or decorative cutouts over 1.75 inches within 45 inches of the ground; temporary 48-inch barrier during construction replaced by permanent fence within 90 days. The dwelling can serve as one side of the barrier if doors to the pool area have self-closing alarms or a power safety cover meeting ASTM F1346. Penalties can reach 5,000 dollars per day under GBL 224-a.
Non-compliant barrier: up to 5,000 dollars per day under GBL 224-a; stop-work and denial of Certificate of Occupancy until corrected. Signage violations: 500 dollars first / 1,000 dollars subsequent.
