Every residential pool and spa in unincorporated Shawnee County must be enclosed by a barrier under the county's adopted International Residential Code, at least 48 inches high with a self-closing, self-latching gate.
Under the International Residential Code adopted through City of Topeka Title 14, every residential in-ground and above-ground pool and spa in unincorporated Shawnee County must be surrounded by a barrier at least 48 inches high, with no footholds and no opening a 4-inch sphere can pass through. Gates must be self-closing and self-latching, open outward away from the pool, with the latch release at least 54 inches above grade. A dwelling wall may form part of the barrier if the doors leading to the pool have alarms or self-closing devices. Barrier compliance is verified at the pool permit's final inspection.
A pool without a compliant 48-inch barrier fails inspection and cannot receive final approval. An existing non-compliant barrier draws a correction order and carries serious drowning-liability exposure.
