Sec. 155.054 requires a 6-foot non-climbing safety fence around any in-ground pool. Above-ground pools require a 4-foot non-climbing fence OR a latchable rigid cover. A 6-foot construction fence is required from the moment the pool contains water during build-out.
St. Michael's pool fencing rule echoes Minnesota Rules 4717.1550 but adds the residential 4-foot above-ground option. The construction fence must be made of snow fence or similar design, securely anchored, base flush to the ground, with posts no more than 8 feet apart. The permanent fence must be non-climbing β no external hand-holds or footholds β and may not have openings large enough for a toddler to pass through. Gates must self-close and self-latch with hardware out of toddler reach. The city's separate Pool Fencing Agreement codifies the owner's commitment to maintain the barrier in perpetuity.
Operating a pool without a compliant barrier is a misdemeanor (up to $1,000 / 90 days). The city may order the pool drained until compliant. State pool barriers are independently enforced by the MN Department of Health under Minn. Rules 4717.
