For private residential spas and hot tubs, Appendix AG of the Residential Code of Ohio exempts a spa or hot tub from the enclosure/barrier rules if it is equipped with a safety cover complying with ASTM F1346. Public spas are treated as public swimming pools: Ohio rule 3701-31-01 defines a 'public spa' as a public swimming pool operated as a smaller (under 5,000 gallons), higher-temperature (over 90 degrees Fahrenheit) pool for recreational or nonmedical use, licensed and inspected by Summit County Public Health.
Public spa violations are enforced by SCPH under ORC 3749 (license suspension/closure). Residential barrier/cover violations are enforced by local building departments.
