New Jersey regulates hot tubs and spas through the statewide NJ Swimming Pool and Spa Code, applied by the municipal construction office, not the county. Section 305.6 provides that where a spa or hot tub is equipped with a lockable safety cover complying with ASTM F1346, the area is not required to comply with the barrier provisions of Sections 305.2 through 305.7. Without such a cover, a compliant 48-inch barrier with a self-closing, self-latching gate is required. Electrical bonding and GFCI protection are inspected under the code. Check municipal setback and screening requirements before installing.
A spa lacking a compliant cover or barrier fails inspection; municipalities can require correction and impose ordinance penalties.
