Carmel regulates hot tubs and spas exactly like pools: same 10-foot setback, and a barrier or safety cover. A hot tub cover complying with the Indiana swimming pool code, 675 IAC 14-4.3-296, satisfies the barrier requirement.
Under Carmel UDO 5.02(C)(7), a hot tub, its deck or equipment is grouped with swimming pools for setback and safety purposes: at least ten feet from side and rear lot lines or three feet from an easement. The same safety-barrier options apply, but Carmel expressly accepts a cover that complies with the Indiana swimming pool code, 675 IAC 14-4.3-296, as amended, in lieu of a fence. That aligns with the ISPSC exemption for spas with a listed locking safety cover. Fishers, Westfield and Noblesville treat spas similarly under the Indiana Residential Code. A hot tub still requires an electrical/building permit for wiring and installation.
An uncovered, unfenced spa is a barrier-code violation; cities can require a compliant cover or fence and issue fines until corrected.
