Under 77 Ill. Adm. Code 820.10, a 'spa' includes therapeutic pools, hydrotherapy pools, whirlpools, hot spas, and hot tubs, and covers public and semi-public units at apartments, clubs, hotels, and health facilities. Those must meet state permitting, barrier, and sanitation standards. Spas 'at individual single-family residences intended for use by the occupant and his or her guests' are excluded from the state code. In unincorporated Kane County, a private hot tub still typically needs a county electrical permit and must meet setback and barrier or safety-cover requirements; cities set their own hot-tub rules.
A public spa operating without state approval can be closed by IDPH or the county Health Department; unpermitted electrical work faces county code penalties.
