Newark hot tubs follow the same NJ UCC rules as pools. A permit is required, barriers or locking covers apply, and VGB Act drain covers are mandatory.
Under the NJ Uniform Construction Code (N.J.A.C. 5:23) and the 2018 International Swimming Pool and Spa Code, hot tubs and spas are classified alongside swimming pools and are subject to the same permitting and safety standards in Newark. A building permit is required for installation of any spa or hot tub capable of holding water deeper than 24 inches. Electrical sub-code permits are required for the dedicated circuit, GFCI protection, and proper bonding and grounding of all metal components. Hot tubs and spas must be enclosed by a 48-inch barrier or, as an alternative, may use a locking safety cover that meets ASTM F1346 standards. A compliant safety cover must be able to support the weight of a child and have a locking mechanism that prevents unauthorized access. When the cover is removed, the barrier requirements apply in full. The federal Virginia Graeme Baker Pool and Spa Safety Act requires anti-entrapment drain covers meeting ASME/ANSI A112.19.8 on all spa suction outlets. Spas with a single main drain must have a safety vacuum release system. Water temperature must not exceed 104 degrees Fahrenheit per manufacturer and code guidelines. Newark zoning setback requirements for accessory structures apply to permanently installed hot tubs. Portable plug-in hot tubs that do not require hardwired electrical connections may be exempt from the building permit but still require GFCI protection on the outlet and must comply with barrier or cover requirements.
